By accessing or using Parkie ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including community board members and residents.

2. Description of Service

Parkie is a software-as-a-service platform for homeowner association (HOA) and community management. Features include payment collection, violation tracking, document management, communication tools, AI-powered assistance, and compliance guidance. Parkie is a management tool — it is not a law firm, property management company, or financial advisor.

3. Account Responsibilities

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your password
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • You must be at least 18 years old to create an account

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload malicious code, spam, or harmful content
  • Attempt to gain unauthorized access to other accounts or systems
  • Harass, threaten, or discriminate against other users
  • Scrape, crawl, or automatically extract data from the Service
  • Resell or redistribute the Service without authorization
  • Circumvent rate limits or other security measures

5. Payments & Billing

Paid plans are billed monthly via Stripe. You authorize us to charge your payment method on a recurring basis. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are provided at our discretion. All fees are exclusive of taxes unless stated otherwise.

6. AI-Generated Content

Parkie uses artificial intelligence to generate content including violation notices, meeting minutes, compliance alerts, and reserve forecasts. AI-generated content is provided for convenience and guidance only. It does not constitute legal, financial, or professional advice. You are responsible for reviewing, editing, and approving all AI-generated content before use. Parkie is not liable for errors, omissions, or consequences arising from reliance on AI-generated content.

7. Compliance Information

State-specific compliance rules, late fee caps, and regulatory guidance provided by Parkie are for informational purposes only and do not constitute legal advice. Laws change frequently. Always consult a licensed attorney in your state for specific legal questions. Parkie is not liable for any actions taken based on compliance information provided through the platform.

8. Intellectual Property

Parkie and its original content, features, and functionality are owned by Parkie and protected by copyright, trademark, and other intellectual property laws. You retain ownership of content you upload to the Service. By uploading content, you grant us a license to use it to provide the Service.

9. Limitation of Liability

To the maximum extent permitted by law, Parkie and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

11. Termination

We may suspend or terminate your account if you violate these terms. You may delete your account at any time through your profile settings. Upon termination, your right to use the Service ceases immediately. We may retain anonymized data as described in our Privacy Policy.

12. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.
